Acceptance of “Terms and Conditions of Use”
These “Terms and Conditions of Use”” govern your use of TOYconomy LLC and its website services and any products you may receive or request through TOYconomy LLC. If you do not agree to these “Terms and Conditions of Use”, you may not use the services provided by TOYconomy. The “Terms and Conditions of Use” on this site are an ongoing contract between you and TOYconomy LLC and apply to your use of the TOYconomy plans and website or products, if any, you receive therefrom. The following “Terms and Conditions of Use” affect your rights and you should read them carefully before registering for an account and placing orders with TOYconomy.
Changes to “Terms and Conditions of Use”
TOYconomy LLC reserves the right to change these “Terms and Conditions of Use” at any time with or without notice to you. The “Terms and Conditions of Use” will be updated at TOYconomy's sole discretion and it is your (the User) responsibility to check for updates. You (the User) will be bound to any changes should you choose to continue use of services provided by TOYconomy LLC.
Privacy Notice
Any and all information submitted on the TOYconomy website will be protected using an SSL certificate. When you enter a protected page where you submit any personal information, you will see a “padlock” icon pop up in the browser window at the top of your page. This icon let's you (the User) know that the internet connection is now secure and all information submitted on that webpage is encrypted. TOYmember Terms
Monthly Membership Fee
Membership is $9.99 per month. New TOYmembers will be charged $1.00 for the first month of membership and will receive all member benefits, including free shipping, 50% off rental fees, no restrictions or due dates and any other benefits listed exclusively for members, after completing their membership order. After the first month, the TOYmember's chosen method of payment will be charged $9.99 a month until membership is cancelled. TOYmembers may cancel at anytime after 60 days. However, all rented products must be returned within 10 business days of cancellation or the TOYmember's chosen method of payment will be charged for the price of purchasing the products (30% off the retail value).
Rental Fees
TOYmembers enjoy 50% off all rental fees. TOYmember rentals are recurring fees, which means the discounted TOYmember rental fee will be charged to the chosen method of payment every 30 days until a request for pickup is made. TOYmembers should request a scheduled pickup day when ready to return the products and the recurring rental fee will be suspended at the time the pickup is requested (note: can request pickup as early as one week prior to pickup date).
Restrictions, Due Dates, Minimums
No restrictions, minimums, or due dates for TOYmembers. TOYmembers can order as many or as few products as desired. TOYmembers may return a product in one week, or keep it for 30 months or more. TOYmembers may also ship to multiple addresses in any given month at no extra charge for shipping.
Shipping
Shipping is ALWAYS free for TOYmembers.
Returns
TOYmembers are responsible for scheduling their pickup when they are ready to return the products. TOYmembers should email orders@toyconomy.com to request a pickup date and can go to Schedule My Pickup for more information. Please note: your chosen method of payment will be charged the discounted product rental fee every 30 days until the product(s) is returned.
On your scheduled pickup day, you should have the product(s) packaged in the original box and packaging material and leave it outside your door by 8:00 a.m. FedEx will pick up your box directly from your shipping address between 8:00 a.m. and 6:00 p.m.
Non-Member Terms
Non-members do not pay a monthly fee and have no monthly obligations or commitment.
Rental Fees
Non-members pay the standard, 30-day rental fees listed on the site. Rental fees are a one-time fee for non-members.
Restrictions, Due Dates, Minimums
Non-member orders are for 30 days only and must meet our $25 minimum requirement before completing your order. TOYconomy will schedule a pickup date for non-members and we will email your pickup date instructions to you as well as two reminders before your scheduled pickup day.
Shipping
Non-members pay a flat $8.99 shipping fee for every order.
Returns
Non-members will be given a scheduled pickup day after placing your order. Your pickup date and instructions will be emailed to you.
On your scheduled pickup day, you should have the product(s) packaged in the original box and packaging material and leave it outside your door by 8:00 a.m. FedEx will pick up your box directly from your shipping address between 8:00 a.m. and 6:00 p.m.
NOTE: if you do not return your products on your scheduled pickup day and do not drop them off at a FedEx location for return shipment within 5 business days of your scheduled pickup day, your chosen method of payment will be charged for the discounted price of purchasing the products.
Payments and Refunds
All payments are final . Requests for refunds will be handled on a case-by-case basis and are not guaranteed.
Delivery of Products
Packages will be delivered and returned through FedEx. A return label will be included with your shipment. Please email orders@toyconomy.com if you lose your return label and we will email one to you. FedEx will pickup all returns directly from your shipping address on your scheduled pickup day. More information will be emailed to you after placing your order.
Broken, Damaged, and Lost Toys or Items
If a toy or product is broken when you receive it, please contact TOYconomy within 48 hours of receiving your shipment. We will send you a shipping label to return the broken toy and will ship a new one to you (at no additional charge) immediately.
If a toy is broken while under your care, please contact us immediately. If the damage is not repairable or if the damage, even if repaired, lessens the normal full use of the toy, you may be required to purchase the toy.
If you misplace a piece or accessory, please contact us or note this on your return form. You may be charged a small replacement fee (normally $5 or less). If you find the piece within 10 business days, you can ship the piece back to us (at your expense) and you will not be charged any additional fees.
If you purchase TOYsurance, there will be no additional costs for replacing broken toys or missing pieces. TOYconomy assumes all costs for replacement.
Customer Conduct and Care Policy
Normal wear and tear on toys is to be expected. However, when returning the toys to us, please make sure they are in good condition, any visible spots or dirt are wiped clean, and the toys are odor-free (i.e. not smelling of smoke or other unpleasant odors). If a toy or product is returned to us in a less-than-satisfactory condition, you may be requested to pay an additional fee to replace the toy or product.
Disclaimers of Warranties and Limitations on Liability
TOYconomy LLC, including all features associated therewith and products or toys received therefrom, the website and its contents are provided "as is" with all faults and without warranty of any kind. We make no representations or warranties of any kind with respect to the service or the website and its contents or the products you receive. We assume no liability or responsibility for any error or omissions in the content of the website, any failures, delays, or interruptions in the shipment of products or the conditions of or use by you or anyone else of the products you may receive through us. To the extent allowable by the law, we disclaim all representation and warranties, including warranties of merchantability, satisfaction, quality, condition of the products, fitness for a particular purpose, and non-infringement. Furthermore, we do not represent or warrant that the information accessible via our website is accurate, complete or current. We do not represent or guarantee that your use of our service will be free from loss, attack, corruption, viruses, interference, hacking, or any other possible security intrusion and we disclaim any liability with respect thereto. No oral or written information or advice given by us or our authorized representative shall create a warranty or otherwise constitute a representation binding upon TOYconomy, its principals, officers, employees or assigns, or its affiliated parties. In no event shall we or any of our shareholders, directors, officers or employees be liable (severally or jointly) to you for personal injury or any special, incidental, indirect or consequential damages of any kind or any damages whatsoever resulting from use, loss of use, data or profits, business interruption or any other commercial damages or loss, whether or not advised of the possibility of damage, and on any theory of liability, arising out of or in connection with the use or performance of the TOYconomy service or website or its contents, including any features associated therewith. Under no circumstance shall our total liability to you for all damages for losses arising from the use or inability to use our website, its contents or our service, including any features associated there-with exceed the amount of one month's fee for your subscription plan. The foregoing limitations will apply even if the above stated remedy fails of its essential propose. If any applicable authority holds any portion of this section to be unenforceable, then liability will be limited to the fullest possible extent permitted by applicable law.
Personal Injury Liability
Users of TOYconomy LLC agree that they will not hold TOYconomy LLC or any of its officers, employees, principal or representatives legally responsible for any injury resulting from the use of a toy or product obtained through TOYconomy. It is your responsibility to ensure that all children are safe while using TOYconomy toys or products.
Conduct
When registering for an account or browsing our website, you agree to our rules and regulations for website conduct: you agree not to upload, post, e-mail, send or transmit any material that contains software viruses or any other computer codes, files, or programs designed to cause havoc to, interrupt, destroy, or limit the functionality of any computer software or hardware associated with the TOYconomy website. You also agree to not interfere with the servers or networks connected to the TOYconomy website.
When you sign up for an account, you are stating that all personal information is correct and accurate. It is your (the User's) responsibility to update information in your account when necessary. You can update your information any time when you log in to your account or you can send an email toorders@toyconomy.com or info@toyconomy.com.
You agree, while using our website, to not impersonate any other person, be vulgar or offensive, or use the TOYconomy website for any illegal purpose.
You must be at least 18 years of age to use our service and sign up for a monthly subscription plan.
All images and content belong to TOYconomy LLC and you agree to not copy or duplicate any images or content for your own personal gain or commercial use.
Right to Terminate
We reserve the right to restrict or terminate your use of the TOYconomy service, without notice, for any reason.
Safety and Parental Supervision
TOYconomy LLC cares about the safety of all customers and will do our best to warn parents or guardians about potential choking hazards or other dangers that could harm young children. HOWEVER, IT IS THE RESPONSIBILITY OF YOU TO KEEP CHILDREN SAFE WHILE USING TOYS OR OTHER PRODUCTS FROM TOYCONOMY LLC. Customers should make note of warnings about choking hazards on the product details pages. We encourage customers who have a specific concern about a product to visit the manufacturer's website directly. If TOYconomy learns about a recall for a product(s) on our site, the product(s) will be removed immediately and we will communicate this knowledge with our customers via email.
Please note that some shipping materials may be hazardous to young children and should be kept out of reach. The box and other shipping material should be used only for that purpose and should not be under the possession of a child. IT IS THE RESPONSIBILITY OF YOU TO REMOVE SHIPPING MATERIALS IMMEDIATELY UPON RECEIPT OF THE SHIPMENT AND PLACE THEM OUT OF THE REACH OF ALL CHILDREN. TOYCONOMY LLC IS NOT RESPONSIBLE FOR ANY HARM OR DAMAGE CAUSED TO ANY PERSON AS A RESULT OF SHIPPING MATERIALS, TOYS, OR OTHER ITEMS IN YOUR SHIPMENT.
